Terms of Service

By accessing or using the Rilev website, application, or assessment services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

By using the Service, you confirm that you are at least 18 years old and have the legal capacity to enter into this agreement. If you are under 18 years of age, you are strictly prohibited from using the Service. We do not collect verifiable parental consent, so minors are not permitted to use this platform under any circumstances.

These Terms constitute a legally binding agreement between you and Rilev Inc. ("Rilev," "we," "us," or "our"), a company registered in Delaware, United States.

Rilev provides informational outputs based on self-reported responses and validated questionnaires. The Service does not provide medical advice, does not diagnose conditions, and is not a substitute for professional medical or mental health care.

If you believe you may be experiencing an emergency, contact local emergency services immediately.

No Provider Relationship: Use of the Service does not create a doctor-patient, therapist-client, or any fiduciary relationship between you and Rilev Inc.

Automated System: You acknowledge that the Service is an automated system and is not monitored by humans in real-time. No Rilev employee reviews your individual responses or results.

Context of Clinical Scales: We use clinically validated questionnaires (e.g., PHQ-9, GAD-7) combined with AI-powered pattern recognition to structure our analysis. However, an automated score or pattern identified by our methodology does not constitute a formal medical diagnosis. A high score indicates a pattern of responses that may warrant professional evaluation—it is not a diagnosis.

AI-Generated Insights: Our Service uses artificial intelligence to analyze patterns in your responses. AI-generated insights represent statistical correlations and patterns, not clinical judgments. These insights should be considered as informational starting points for self-reflection, not as professional conclusions about your mental health status. AI systems have inherent limitations and may produce results that do not apply to your specific situation.

Self-Reported Data: Results are based entirely on information you provide. We cannot verify the accuracy or honesty of your responses. The quality and accuracy of your results depend on the accuracy and honesty of your input.

Seek Professional Help: The Service is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician, psychologist, or other qualified health provider with any questions you may have regarding a medical condition.

The Service uses an anonymous account system. You are responsible for maintaining the confidentiality of your account access credentials (including any private key or recovery factors you enable).

We cannot restore access if you permanently lose your access credentials unless you have enabled the recovery features we provide.

Report Reference Code: Your results also include a Report Reference Code (e.g., #8X92-LP). This code can be used to request data deletion if you lose access to the app but have saved the code.

Single User Per Key: Each account credential is intended for use by one individual only. You may not share your credential with others or allow others to complete assessments using your account.

By using the Service, you consent to the collection, use, and disclosure of information as described in the Privacy Policy. Consent is required for collecting and using personal information in commercial activities, subject to limited exceptions.

De-identified and aggregated data. By using the Service, you agree that we may create and use de-identified and/or aggregated data derived from your use of the Service (including assessment responses, scores, derived metrics, and optional device signals) for:

• Product improvement, benchmarking, and quality assurance;
• Scoring calibration and normalization;
• Evaluating reliability and measurement drift;
• Developing and improving internal analytics and statistical models;
• Research and development.

We take steps designed to ensure de-identified data does not reasonably identify you. Once data is de-identified in a way that we cannot re-link to an individual account, deletion requests may not be able to remove already-de-identified data from aggregate analyses.

If you choose to connect Apple Health/HealthKit, you authorize the Service to access the specific HealthKit data types you select.

• We will use HealthKit data only to provide and improve health/fitness-related features you request.
• We will not use HealthKit data for advertising or disclose it for advertising.
• You can revoke HealthKit permissions at any time in iOS Settings / Apple Health.

A. Pricing

The assessment and related premium features (e.g., Decode) may be sold as a one-time purchase or on a recurring subscription basis as described on our pricing page. All prices are in USD unless otherwise displayed at checkout.

B. Subscription and Auto-Renewal

If you purchase a recurring subscription:

• Your subscription will automatically renew at the end of each billing cycle unless you cancel it at least 24 hours before the renewal date.
• You authorize us (via our payment processor) to charge the applicable subscription fees to your designated payment method.
• You may cancel your subscription at any time through your account settings or, if purchased via an app store, through the applicable app store subscription management page.
• Cancellation takes effect at the end of your current billing cycle. You will retain access to premium features until that cycle ends.

C. Payment Processing

Payments are processed securely via Stripe or appropriate App Store payment gateways. We do not store full payment card details; payment details are handled by our payment providers.

D. Refunds

Because access may be granted immediately and our system is designed to minimize persistent linkage between purchases and accounts, refunds may be limited. Refunds are not provided except where required by applicable law, or where we explicitly approve an exception in writing. Subscriptions canceled mid-cycle are not eligible for pro-rated refunds.

We may offer promotional, referral, or special pricing codes. Codes may be limited, may expire, may be restricted to certain users or channels, and may be revoked if we reasonably believe they are being used fraudulently or in violation of these Terms.

Age Requirement: You must be at least 18 years old to use the Service. Users under 18 are strictly prohibited from using the platform.

Personal Use: The Service is for your personal, non-commercial use. You may not resell, redistribute, or share assessment keys with others.

Honest Self-Report: You agree to answer assessment questions honestly and to the best of your ability. The accuracy and usefulness of your results depend entirely on the truthfulness of your responses.

Not for Third-Party Assessment: You may not use the Service to assess another person without their knowledge and explicit consent. The Service is designed for self-assessment only.

Prohibited Acts: You agree not to:

• Reverse engineer the algorithms or scoring logic of the Service
• Use the Service to generate reports for others without their explicit consent
• Attempt to compromise the security or anonymity features of the platform
• Use the Service for any unlawful purpose
• Interfere with or disrupt the Service or servers
• Attempt to re-identify anonymous data or link it to individuals
• Use automated systems or bots to access the Service

A. Voluntary Sharing

You may choose to share your assessment results with a licensed mental health professional. This sharing is entirely voluntary and initiated by you.

B. What Therapists See

When you share results with a therapist, they will see:

• Your assessment scores
• Pattern analysis and insights
• Flagged areas of potential concern

Therapists will NOT see:

• Your individual question responses (we don't store them)
• Any identifying information (we don't have it)

C. Your Control

You initiate all sharing. You can revoke a therapist's access at any time. Therapists cannot access your data without your explicit permission.

D. Not a Referral

Rilev Content: The visual interfaces, graphics, design, compilation, computer code, products, software, AI models, machine learning algorithms, assessment frameworks, and aggregate findings are the property of Rilev Inc. and are protected by copyright, patent, and trademark laws.

AI Technology: The artificial intelligence and machine learning systems powering the Service, including all trained models, pattern recognition algorithms, and analytical methods, are proprietary to Rilev Inc. You may not attempt to reverse engineer, extract, or replicate these AI systems.

Third-Party Clinical Scales: Some clinical scales used within the Service (e.g., PHQ-9, GAD-7) may be subject to copyright held by third parties or are in the public domain. You are granted a limited, non-exclusive license to use these tools for personal assessment purposes only through the Service.

Your Data: You retain ownership of your specific responses and generated report. By using the Service, you grant Rilev a non-exclusive, worldwide, royalty-free license to use fully anonymized, aggregated data (which cannot be linked to you) for research, product improvement, and statistical analysis purposes.

To the fullest extent permitted by law, Rilev Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including:

• Loss of profits, revenue, or data
• Loss of use, goodwill, or other intangible losses
• Your inability to access or use the Service
• Any third-party conduct or content on the Service
• Unauthorized access to your transmissions or content
• Loss of your access credentials or Report Reference Code
• Errors, omissions, or inaccuracies in AI-generated insights
• Your reliance on assessment results for any purpose

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for certain damages. If these laws apply to you, some or all of the above disclaimers or limitations may not apply, and you may have additional rights.

You agree to defend, indemnify, and hold harmless Rilev Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected with:

• Your access to or use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any claim that your use of the Service caused damage to a third party
• Your failure to seek appropriate professional help when needed

By You: You may stop using the Service at any time. To delete your data, use the "Delete My Data" feature with your account credentials, or email privacy@Rilev.com with your Report Reference Code.

By Us: We reserve the right to suspend or terminate your access at our sole discretion, without prior notice, for:

• Violation of these Terms
• Conduct harmful to other users, us, or third parties
• Suspected fraud or abuse
• Any reason we deem necessary to protect the Service

Upon termination, your right to use the Service ceases immediately.

We aim to keep the Service available 24/7 but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

• Scheduled maintenance
• System updates
• Technical issues
• Circumstances beyond our control

We are not liable for any loss, inconvenience, or damages caused by service interruptions.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

Dispute Resolution: To the extent permitted by applicable law, any dispute arising from or relating to these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court.

Exceptions: Nothing in this section shall prevent either party from seeking injunctive or other equitable relief in court for matters related to intellectual property or unauthorized access to the Service.

Your Local Rights: If you are a consumer in a jurisdiction with laws that grant you additional rights that cannot be waived by contract (such as the European Union or California), those rights are not affected by these Terms.

International Users

While our Service may be accessible internationally, it is designed and optimized for users in Canada and the United States. You are responsible for compliance with your local laws regarding the use of health-related services.

By using the Service, you consent to receive communications from us electronically, including via website notices and updates to these Terms. You agree that all agreements, notices, and communications provided electronically satisfy any legal requirement that such communications be in writing.

We reserve the right to modify these Terms at any time. If we make material changes, we will post the revised Terms on our website with an updated "Last Updated" date.

Your continued use of the Service after such changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Rilev regarding the Service and supersede all prior agreements and understandings.
